A note from the founder
I built PeakWorth after years of relying on detailed financial models to make major decisions for my own family—from career moves to home purchases to retirement planning. Professionally, I've spent my career helping technology companies make complex financial decisions as a CFO, and I previously practiced as a licensed CPA. Those experiences shaped how I think about balancing today's choices against long-term financial outcomes.
Over time, I realized households deserved the same kind of decision engine that businesses rely on. That's why I built PeakWorth—to help people make better financial decisions with greater confidence and a clearer understanding of the long-term tradeoffs.
If you trust us with your financial information, I believe we owe you complete transparency about how we protect it. PeakWorth exists to help people make better financial decisions—not to monetize their financial data or push financial products.
1. Acceptance of Terms
2. Description of Service
2a. AI-Powered Insights
Portions of the Service — including the AI Advisor chat, generated commentary on your projections, and any feature labeled as "AI" — are produced by large language models operated by third-party providers (currently Anthropic). These features generate suggestions and explanations from the financial data you have entered or linked, plus the prompt you provide.
AI-generated output:
- Is informational and educational only, and is not personalized investment, tax, legal, or insurance advice;
- May be incomplete, out of date, or factually incorrect, including with respect to tax law, contribution limits, market data, and product features;
- Does not consider your full personal circumstances, suitability, or risk tolerance, and is not a fiduciary recommendation;
- Should be independently verified before you act on it, ideally with a licensed professional;
- Is provided on a read-only basis — the AI Advisor cannot place trades, move money, change account credentials, link or unlink institutions, modify your subscription, or take any action on your behalf inside or outside the Service.
You are responsible for any decision you make based on AI-generated output. When you use AI features, PeakWorth sends only the financial context necessary to answer your request to its contracted AI provider (currently Anthropic). We do not send bank login credentials, full account numbers, or government identifiers. These requests are processed under the provider's commercial API terms and are not used to train public or general-purpose AI models. Limited retention and authorized review of AI requests and responses may occur for security, abuse prevention, and service reliability, as described in our Privacy Policy. As a practical safeguard, please do not paste government identifiers or full account numbers into AI chat messages — the Service never needs them.
2b. Projections Are Hypothetical
3. Account Registration and Eligibility
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials, including any two-factor authentication factors and backup codes
- You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) and able to form a binding contract under applicable law to create an account. The Service is not directed to, and we do not knowingly collect personal information from, anyone under 18. When you register you must affirm that you are at least 18, and we may terminate any account we learn belongs to someone under 18
- You may use the Service only in jurisdictions where doing so does not violate local law. The Service is operated from the United States and is intended for personal, non-professional use by residents of jurisdictions where it is lawfully available; we do not represent that the Service is appropriate or available in any particular location
- You may not use the Service if you are barred from receiving services under applicable U.S. or other laws (including OFAC-administered sanctions programs)
- You are responsible for all activity that occurs under your account
- You must promptly notify us of any unauthorized use of your account or suspected compromise of your credentials or two-factor factors
4. Subscription Plans and Billing
Free Trial
New accounts receive a 14-day free trial with access to all features. No credit card is required to start a trial.
Paid Plans
After the trial period, continued access to premium features requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis through Stripe.
Cancellation
You may cancel your subscription at any time from your Account page. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods, except as described in our Refund & Cancellation Policy (billing errors, accidental renewals within 14 days where the account was not used after the renewal, unauthorized charges, and refunds required by law).
Price Changes
We reserve the right to change subscription pricing. We will provide at least 30 days' notice before any price increase takes effect for existing subscribers.
5. Acceptable Use
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or its infrastructure
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated means (bots, scrapers) to access the Service without permission
- Share your account credentials outside your household. A spouse or household partner may participate in your plan through functionality expressly provided by PeakWorth for that purpose; credentials may not be shared with anyone outside your household
- Upload malicious code or content
- Use the Service to provide financial advice to third parties in a professional capacity
6. Intellectual Property
7. User Data and Privacy
8. Third-Party Services
The Service integrates with third-party providers, including Plaid Inc. (account linking), Stripe, Inc. (payment processing), and Anthropic, PBC (AI insights). When you use these integrations:
- Your use of each integration is subject to that provider's own terms of service and privacy policy, which you should review before connecting;
- Account linking through Plaid is initiated by you; you authorize Plaid to access your financial institution and to share read-only data with PeakWorth on your behalf;
- Payment processing through Stripe is performed by Stripe as an independent controller of your payment data; PeakWorth does not store your full card or bank account numbers;
- AI requests sent to Anthropic include only the de-identified, minimized financial context and the prompt content needed to generate a response, as described in Section 2a and in our Privacy Policy.
PeakWorth does not control and is not responsible for the availability, accuracy, security, pricing, or terms of any third-party service, financial institution, or external website linked from the Service. Third-party services are governed by their own terms and may experience outages or errors outside PeakWorth's control. PeakWorth will reasonably assist users in identifying and resolving integration-related issues.
9. Disclaimers
Legal disclaimer: the first bullet below is standard warranty language that U.S. law requires us to present in capital letters. It reads sternly, but it is the same disclaimer found in most software terms.
- THE SERVICE, INCLUDING ALL PROJECTIONS, AI-GENERATED OUTPUT, AND THIRD-PARTY DATA SURFACED THROUGH IT, IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR ANY WARRANTY ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE
- We do not warrant that the Service will meet your requirements, that any projections, calculations, AI-generated insights, or third-party data will be accurate, complete, current, or reliable, or that any errors will be corrected
- We do not guarantee uninterrupted, secure, or error-free access to the Service, or that the Service will be free of viruses or other harmful components
- Past performance and current projections do not guarantee future results, and PeakWorth does not guarantee any particular financial, investment, tax, or planning outcome
- Any reliance you place on the Service — including on any AI-generated output, projection, or third-party data — is at your own risk; PeakWorth is not responsible for financial, tax, legal, or other decisions you make based on information from the Service
- Some jurisdictions do not allow the exclusion of certain warranties or limitations on implied warranties; in those jurisdictions, the above exclusions apply only to the maximum extent permitted by law and do not affect any non-waivable statutory rights you may have as a consumer
10. Limitation of Liability
11. Indemnification
12. Termination
We may suspend or terminate your account for specific cause, including: violation of these Terms; fraudulent, deceptive, or illegal activity; conduct that threatens the security or integrity of the Service or other users; compliance with a legal requirement or court order; nonpayment of subscription fees after notice; misuse of the Service (including the abuses described in Section 5); or discontinuation of the Service (in whole or in part).
Except where immediate action is necessary to protect the Service, other users, or PeakWorth's legal obligations, we will provide notice before terminating your account and a reasonable opportunity to export your data. If PeakWorth terminates your account, you may request an export of your financial data (the same export available from your Account page), and your data will thereafter be deleted in accordance with our Privacy Policy. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) shall survive.
13. Governing Law
14. Dispute Resolution and Arbitration
Please read this section carefully — it affects your legal rights, including your right to file a lawsuit in court. This arbitration clause remains subject to review by counsel.
Informal Resolution First
Before starting arbitration, you agree to first contact us at support@peakworth.com with a written description of your dispute ("Notice of Dispute"). We will try in good faith to resolve the dispute within 60 days of receiving your notice. Most concerns can be resolved this way.
Binding Arbitration
If we cannot resolve a dispute informally, any dispute arising from these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, available at www.adr.org. To initiate arbitration, you may file a demand with the AAA after completing the informal-resolution step above. The arbitration will be conducted in English, by a single arbitrator, and may proceed by videoconference, telephone, or written submissions unless an in-person hearing is required by the AAA rules or requested by either party.
Fees
Payment of filing, administration, and arbitrator fees will be governed by the AAA Consumer Arbitration Rules, which cap the fees a consumer can be required to pay. If the arbitrator finds your claim was not frivolous, PeakWorth will not seek to recover its own attorneys' fees from you unless permitted by applicable law.
Exceptions
Either party may bring an individual claim in small-claims court instead of arbitrating, and either party may seek injunctive or other equitable relief in court to protect its intellectual property or prevent unauthorized access to the Service.
30-Day Opt-Out
You may opt out of this arbitration agreement by emailing support@peakworth.com within 30 days of first accepting these Terms, stating your name, account email, and that you opt out of arbitration. Opting out does not affect any other part of these Terms.
Class-Action Waiver
Disputes will be arbitrated only on an individual basis. Neither you nor PeakWorth may participate in a class action, class-wide arbitration, or representative proceeding, except that this waiver does not apply where prohibited by law. If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court rather than arbitration.
